A condo purchase where the status certificate changes the deal

The agreement is signed and the closing date is set before anyone reads the corporation's own paperwork. That is the wrong order.

The situation

A buyer has an accepted offer on a condominium and a financing condition running out. The status certificate has arrived and nobody has read it closely. Reserve fund health, pending special assessments, rule changes and litigation against the corporation all live in that package, and all of them survive closing.

What the work involves

  1. Read the status certificate and the declaration against the agreement of purchase and sale, and identify what the buyer is actually assuming on closing.
  2. Advise on the conditions still available while they remain available, rather than after they expire.
  3. Run title and off-title searches, and raise requisitions inside the contractual deadline.
  4. Report to the lender, prepare the closing documents, and complete the transaction in Teraview.
