Commercial Litigation

Shareholder, partnership and contract disputes between businesses.

In short

Business disputes drain time and money. Commercial litigation runs a set course: pleadings, discovery, motions, trial. The side that prepares earliest usually sets the terms, by settlement or judgment.

Scope of work

What we take on inside commercial litigation, and what each piece of it involves.

  • Shareholder disputes

Oppression claims, buy-sell breakdowns, deadlocked boards and departing partners.

  • Contract disputes

Supply agreements, service contracts and commercial terms that were not honoured.

  • Business torts

Fraud, misrepresentation, interference with economic relations and misuse of confidential information.

  • Debt recovery

Unpaid invoices and loans pursued through the courts, garnishment and asset enforcement.

  • Injunctions

Freezing assets, halting a transaction or preserving evidence when the court has to act now.

How it proceeds

The order the work runs in, so you know what comes next.

  1. Case assessment

Your documents, the other side's exposure, the legal merits and the realistic range of outcomes. We will not promise you a result.

  2. Pre-litigation pressure

Demand letters, negotiation and mediation resolve many disputes before court, faster and for less, when the conditions are right.

  3. Litigation execution

Tight pleadings, thorough discovery, motions that count, and cross-examination that tests the other side's account.

  4. Judgment & enforcement

A judgment still has to be collected: garnishment and asset enforcement where the other side does not pay.
